About these terms

This website is operated by Priority Lawn & Landscape LLC, doing business as Priority Landscape & Outdoor Living, at 7501 Gracely Drive, Cincinnati, OH 45233. Using this site means you accept the terms below. If you do not agree with them, please do not use the site.

These terms cover the website itself, quote requests and material orders. The written quote or contract we give you for a specific job governs that job, and where it differs from anything here, the quote or contract wins.

Using this website

You may use this site to learn about our services, request a quote and order material. Please do not use it to submit false information, attempt to interfere with how the site works, or copy our photos, project images or written content for use elsewhere without asking.

We try to keep everything on the site accurate and current. Service descriptions, availability and timelines can change, and errors happen. Nothing on this site is an offer to enter into a contract.

Quote requests

Submitting a quote request starts a conversation. It does not create a contract or reserve a place on our schedule.

• We aim to respond within one business day.
• Most work requires an on-site visit before we can quote it, because slope, drainage and access affect both what is possible and what it costs.
• The on-site visit and the written quote are free, and neither obligates you to hire us.
• A quote is valid for the period stated on it. Material costs move, and so do our schedules.
• Work is scheduled once you accept a quote in writing.

Materials orders

Pricing is confirmed before anything is loaded

Prices shown on this site are current at the time of publishing and can change. Some materials, including stone and limestone, are priced by size, so the figure shown is a starting price. Submitting a materials order is a request, not a purchase. We will contact you to confirm the material, the quantity, the price and a time before anything is loaded or delivered.

The calculator is an estimate

The material calculator on this site works out an approximate quantity from the measurements you enter. It is a planning tool. Actual quantity depends on the depth you settle on, how accurate your measurements are and the condition of the ground. We recommend rounding up, and we are happy to talk it through before you order.

Pickup and delivery

• Pickup at our yard on Gracely Drive is free, and we will load you.
• Delivery is charged by distance, and the current rates are shown on our materials page.
• Delivery times are scheduled, not guaranteed to the hour. We will tell you if something changes.
• Someone should be available to show us where the material goes, or leave clear instructions. Once a load is placed where you asked, moving it is a separate job.
• Please make sure the delivery area is accessible and that your vehicle or trailer is rated for the load if you are collecting. Stone and topsoil are much heavier than mulch for the same volume.

Weather and scheduling

This is outdoor work. Rain, frozen or saturated ground, snow and heat all affect what can safely be done on a given day, and quality suffers when crews work in conditions that do not suit the job.

• We may reschedule work or a delivery because of weather or ground conditions, and we will tell you as soon as we know.
• Delays caused by weather are not a breach of any agreement, and they do not change the agreed price.
• Snow and ice service runs on conditions rather than a fixed schedule, and priority follows the order in which properties are contracted.
• Plant material and sod depend on watering and aftercare once we leave. We will tell you what a new planting needs.

Payment

Payment terms are set out on your quote or invoice, and the terms below apply unless we have agreed otherwise in writing.

• Material orders are paid at pickup or on delivery.
• Landscaping and hardscaping work is due when the job is complete.
• Commercial accounts are typically net 30 to 60, as agreed in the contract.

Credit card payments on jobs over $1,500 carry a 3% processing fee, which covers what the card networks charge us and no more. Check, cash and bank transfer are not charged a fee. The fee is shown on your quote before you approve it, never added afterward.

Warranty

What is covered depends on the work, and the specific terms appear on your quote.

Plants

Plant material bought through us carries a warranty of up to one year. Plants supplied by the customer are not warranted, because we cannot know how they were grown, stored or handled before they reached us.

Plant warranties assume reasonable aftercare. New plantings and sod need watering, and we will tell you what yours need before we leave.

Patios and retaining walls

We warrant our craftsmanship on paver patios and retaining walls. The length and terms depend on the materials used and are stated on your quote.

Materials carry their own manufacturer warranties, separate from ours. Unilock, our main supplier for pavers and wall block, offers a lifetime transferable warranty on their products, which stays with the property if you sell it.

What is not covered

Damage from things outside our control is not covered. That includes vehicle traffic on a surface not built for it, work done by others, ground movement caused by something we did not install, and neglect of the aftercare we specified.

Photos of completed work

We photograph our own work and may use those photos on this website, in marketing material and on social media. Photos show the work rather than the people who live there, and we do not publish addresses. If you would prefer we did not photograph or publish your property, tell us and we will not.

Text messages

If you give us your phone number we may text you about a request, a quote or a scheduled visit. Message and data rates may apply. Reply STOP to opt out or HELP for help. How we handle phone numbers is described in our Privacy Policy.

Third-party services

Our forms are provided by Jobber, and this site uses Google Analytics and Google reCAPTCHA. Reviews shown here are published by customers on Google and Facebook. Those services have their own terms and policies, and we are not responsible for how they operate.

Limits

This website is provided as it is. We do not warrant that it will always be available or free of errors, and we are not liable for losses arising from your use of the site itself.

Work we perform is covered by the terms of the quote or contract for that job, including any warranty stated there. Nothing on this page limits any right you have under Ohio law.

Governing law

These terms are governed by the laws of the State of Ohio, and any dispute will be handled in the courts of Hamilton County, Ohio.

Changes to these terms

We may update these terms as the business changes. The date at the top shows when they were last revised, and the version published here is the one that applies.
